Analysts are sharing their <a href="https://www.benzinga.com/government/regulations/24/11/42119020/alphabet-bleeds-over-120-billion-in-market-value-eyes-worst-day-in-10-months-after-doj-demands-google-chrome-sale">reactions as well. </a></p>

<p>Pitz described the sweeping remedies proposed by the DOJ as a "kitchen sink moment.&#8221; Pitz noted that the DOJ's proposed remedies extend past Google's search distribution partnerships with Apple and Samsung and included the company's AI search-based investments. </p>
<p>Anmuth echoed similar sentiments regarding the "very comprehensive" set of remedies proposed by the DOJ. He said parts of the remedies are "more punitive than expected" and listed those around consumer choice limitations and the syndication of search data and ads as examples. </p>
<p>The DOJ's proposal should represent the worst-case scenario for Google, reminded Anmuth. He expects Google's proposed final remedies to be much more modest.&nbsp;</p>
<p>"Ultimately, we believe the judge's final decision next summer will be more balanced … and will likely have greater consideration around the potential negative impact to users," the JPMorgan analyst wrote.&nbsp;</p>
<p>Sheridan said the firm does not take a view on a potential outcome of the case. He noted, however, that leadership at the US DOJ will change in January with the incoming Trump administration which adds an additional variable to the potential outcomes of the trial. </p>
<p>The analyst also pointed to recent comments from President-elect <strong>Donald Trump</strong> expressing skepticism on a potential break-up of Google.&nbsp;</p>
<p>"If you do that, are you going to destroy the company? What you can do without breaking it up is make sure it&#8217;s more fair,&#8221; Trump said in October, per Reuters.&nbsp;</p>
<p><strong>Price Action</strong>: According to <a href="https://pro.benzinga.com/?gspk=YWRhbWVja2VydDUzMzY&amp;gsxid=zBMR4PKmcgBw">Benzinga Pro</a>, Alphabet shares are down 1.55% at $166.62 at the time of publication Friday. </p>

In 2021, Thomas called the federal government's stance "half in, half out," highlighting its contradictory approach to state-legal cannabis markets. Schiller's team argues that these contradictions undermine the rationale of the Supreme Court's 2005 decision in Gonzales v. Raich, which upheld federal authority under the Commerce Clause.</p>

In Raich, the federal government successfully argued that a consistent national prohibition was necessary to combat the illicit market. However, Schiller points to subsequent federal actions, such as congressional riders protecting state medical cannabis programs, as evidence that the government has abandoned its eradication strategy.</p>
<p>"Congress has taken steps to move away from the eradication policy," Schiller explains during the interview. He cites examples like the federal allowance of recreational cannabis sales in Washington, D.C., to show that federal priorities have evolved.</p>
<p>The lawsuit also addresses the practical challenges faced by cannabis businesses operating under the shadow of federal prohibition. "The financial consequences imposed by the federal government's continued overhang of illegality has consequences," Schiller says. He highlights issues such as excessive taxation under IRS Code 280E, limited access to banking and loans, and the reliance on cash-based operations due to federal banking restrictions.</p>
<h3 class="wp-block-heading"><strong>Stakes For The Industry</strong></h3>
<p>If successful, the lawsuit could remove significant barriers for cannabis businesses, including the tax penalties imposed by 280E. "Everyone in this industry knows the taxation is discriminatory," Schiller notes, referring to how cannabis businesses are taxed on revenue rather than profit.</p>
<p>The case could also open the door to retroactive tax refunds, potentially worth billions, and pave the way for broader financial reforms. Schiller acknowledges that these changes could have transformative effects on the industry, leveling the playing field for businesses operating within state-legal frameworks.</p>
<h3 class="wp-block-heading"><strong>What's Next?</strong></h3>
<p>Oral arguments in the U.S. Court of Appeals for the First Circuit are scheduled for December 5, 2024. Schiller explains that the court could either uphold the government's motion to dismiss or allow the case to proceed. If the plaintiffs are unsuccessful, the next step would be petitioning the Supreme Court to hear the case, although Schiller acknowledges that the Court takes on a limited number of cases.</p>
<p>"They're very selective," Schiller says of the Supreme Court. "They hear a very small single-digit percentage of the cases that they take on." However, Schiller believes the case could have appeal for some justices, particularly those like Justice Thomas, who have previously critiqued federal cannabis policy. &#8220;We also believe that Justice Gorsuch, who's a well-known author of federalist principles, would be interested in a case like this,&#8221; he adds.</p>
<p>Schiller emphasizes that a favorable ruling could fundamentally alter how the federal government interacts with state-regulated cannabis markets, potentially setting a precedent for other industries navigating federal-state conflicts.</p>

<p><strong>What Happened: </strong>In an <a href="https://www.cnbc.com/video/2024/11/22/crypto-boom-drives-investment-opportunities-with-coinbase-and-robinhood-leading-the-charge.html">interview</a> with CNBC, Ryan emphasized that the evolving regulatory landscape and the increasing acceptance of Bitcoin exchange-traded funds (ETFs) are key catalysts for this transformative growth.</p>
<p>"We have research out saying $220 billion of assets are coming into Bitcoin ETFs in the next three years," Ryan said. "If there is a strategic reserve, that could be hundreds of billions of dollars of assets into Bitcoin."</p>
<p>Ryan pointed out that trading volumes for companies like <strong>Coinbase Inc. </strong>(NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/COIN#NASDAQ">COIN</a>) and <strong>Robinhood </strong>(NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/HOOD#NASDAQ">HOOD</a>) have surged since the U.S. presidential election. </p>

<p>Kunst identified key players in the space, including crypto exchanges and infrastructure firms, as potential acquisition targets for larger financial institutions. </p>
<p>"Names like <strong>FalconX</strong>, the crypto prime brokerage, and <strong>Gemini</strong>, the crypto marketplace, are likely to attract attention from big acquirers," she stated.</p>
<p>While <strong>Bitcoin </strong>CRYPTO: BTC) remains the centerpiece of institutional interest, Kunst sees a broadening investment focus. "Meme coins are dangerous—you can make a lot, but you can lose your shirt," she warned. </p>
<p>Instead, she pointed to stablecoins and cryptocurrency ETFs as safer options, especially for institutions unable to hold crypto directly.</p>
<p>Ryan reinforced this outlook, emphasizing the importance of capital flows. </p>
<p>"Follow the flows, and the flows are still coming—we're in the early days," he said. </p>
<p>Beyond Bitcoin ETFs, Ryan expects tens of billions of dollars to flow into other crypto tokens as regulatory uncertainty diminishes, spurring innovation and further investment in the space.</p>
