According to the filing, Setzer died moments after telling the chatbot—<a href="https://www.benzinga.com/news/23/04/31729836/character-ai-lets-people-talk-with-a-celebrity-receives-350-million-in-andreessen-horowitz-funding-r">impersonating the character</a> Daenerys Targaryen from &#8220;Game of Thrones&#8221;—that he would "come home right now."
Character.AI argued its chatbot&#8217;s outputs were constitutionally protected speech. However, Judge Conway wrote that the company "fail[ed] to articulate why words strung together by an LLM (large language model) are speech."
The startup said it plans to continue defending the case and maintains it uses safeguards to prevent harmful conversations, the report noted.

As part of the deal, Google provided additional funding to Character.AI, although the startup did not disclose the amount.
Still, Garcia's legal team argues that Google played a role by licensing the startup's technology and rehiring its founders. Attorney Meetali Jain called the ruling "historic" and a step forward in "legal accountability across the AI and tech ecosystem."

&#8220;The average spend on design studio selections, structural options, and lot premiums was approximately $200,000 per home in Q2,&#8221; Yearley said, &#8220;these upgrades benefit our margins as they tend to be highly accretive.&#8221;
When asked about mortgage rates and their impact on the business, Yearley said, &#8220;a little tick in mortgage rate&#8221; doesn&#8217;t affect the company&#8217;s clientele all that much. This is because 24% of its buyers pay in cash, and even those who rely on financing have an average loan-to-value ratio of just 70%.
Yearley also added that &#8220;a good part of the 30% of first-time buyers we sell to are getting some help from mom and dad with generational wealth transfer,&#8221; underscoring the financial strength of its core customer base.
